Tip 42 – Meetings – Defects – Act on emergencies

While in most cases you have to provide the developer/builder an opportunity to minimise their losses by fixing the defects, that does not mean that the body corporate can’t act to make the building safe, or preserve property, in an emergency situation. Some defects will render a building un-inhabitable. Given the cost and expense associated with everybody moving out, if it is within the body corporate’s power to attend to what is necessary then it may be wise to do so, after putting the builder/developer on notice.
